Article 1 – Definitions
1.On Point Beauty: On Point Beauty, located in Los Montesinos, Chamber of Commerce number ESX9372775E.
2.Client: The party with whom On Point Beauty has entered into an agreement.
3.Parties: On Point Beauty and the Client collectively.
Article 2 – Applicability
1.These terms and conditions apply to all offers, quotations, activities, agreements, and deliveries of services or products by or on behalf of On Point Beauty.
2.Deviations from these terms are only valid if agreed upon in writing by both parties.
3.The applicability of the general terms and conditions of the Client or third parties is explicitly excluded.
Article 3 – Prices
1.Prices are listed in euros, including VAT and excluding any additional costs such as administrative or shipping fees unless otherwise agreed upon in writing.
2.On Point Beauty reserves the right to adjust prices for its services and products as displayed on its website or in other communications.
3.A total price will be agreed upon for services unless otherwise specified in writing.
4.Price adjustments will be communicated to the Client prior to implementation.
5.If a Client disagrees with a price increase, they may cancel the agreement provided it is done at least 48 hours in advance and the agreement was initially made under the old prices.
Article 4 – Payments and Payment Terms
1.Services/products must be paid for immediately by the Client.
2.On Point Beauty may require a deposit of up to 50% of the agreed amount when entering into an agreement for services.
Article 5 – Withdrawal of Assignment
1.The Client is free to terminate or cancel the assignment at any time.
2.If the Client cancels without providing at least one business day’s notice, they are obligated to pay the agreed-upon fee and any incurred costs.
Article 6 – Complaint Obligation
1.The Client must report complaints about the delivered services immediately. The complaint should include a detailed description of the deficiency to enable an adequate response.
Article 7 – Warranty
1.For agreements involving services, On Point Beauty commits to a best-effort obligation and a results obligation where reasonably expected.
Article 8 – Execution of the Agreement
1.On Point Beauty will execute the agreement to the best of its ability and according to professional standards.
2.Services may be carried out in whole or in part by third parties.
3.The agreement will only be executed after the Client’s approval and payment of any required deposit.
4.The Client must ensure that On Point Beauty can start on time.
Article 9 – Information Provision by the Client
1.The Client must provide all relevant information, data, and documents on time and in the required format.
2.The Client guarantees the accuracy and completeness of the provided materials.
Article 10 – Liability of On Point Beauty
1.On Point Beauty is only liable for damages caused by intent or gross negligence.
2.Liability is limited to direct damages resulting from the agreement.
Article 11 – Expiration Period
1.Any claim for damages by the Client expires 12 months after the event causing the liability.
Article 12 – Termination
1.The Client may terminate the agreement if On Point Beauty fails to meet its obligations.
2.On Point Beauty may terminate the agreement if the Client fails to meet their obligations.
Article 13 – Force Majeure
1.On Point Beauty is not liable for non-performance due to force majeure.
2.In such cases, obligations are suspended.
Article 14 – Changes to the Agreement
1.Adjustments to the agreement are only allowed if necessary for execution.
Article 15 – Changes to Terms and Conditions
1.On Point Beauty may change the terms at any time.
2.Significant changes will be communicated, allowing the Client to terminate the agreement.
Article 16 – Transfer of Rights
1.The Client may not transfer their rights under the agreement without prior consent.
Article 17 – Nullity or Voidability
1.If a provision is found invalid, it does not affect the validity of the other provisions.
Article 18 – Governing Law and Jurisdiction
1.These terms and any related agreements are governed by Spanish law.
2.Disputes will be resolved exclusively by the court in On Point Beauty’s jurisdiction unless otherwise stipulated by law.
